A Well for which drilling commenced on or after September 1, 2009.
Before any new well may be drilled or completed it must be registered with the District and receive specific authorization to commence drilling.
- New Exempt wells must only be registered and meet spacing and completion requirements to obtain drilling authorization.
- New Non-Exempt wells must be registered; must meet spacing and completion requirements or apply for and obtain a variance; and application must be made for all appropriate permits and authorizations required by the District Rules.
New Exempt Wells
To qualify as a New Exempt Well under the Rules of the District the well to be drilled Must:
(1) meet the tract size and spacing requirements found in Appendix A of the District Rules and:
(A) be equipped so that it is incapable of producing more than 25,000 gallons per 24 hour period.
(B) be drilled on a tract smaller than 10 acres in size with a casing diameter not larger than 5 inch
inside diameter which complies with (A) above.
(2) drilled on a tract of any size which was platted prior to September 1, 2009 and not subsequently
divided into smaller tracts with a casing diameter of not more than 5 inch inside diameter and
incapable of producing more than 25,000 gallons per 24 hour period.
(3) drilled or operated as leachate wells and monitoring wells.
